Ho-Chunk Nation Elections Update

     On February 18, 2025, the Ho-Chunk Nation Trial Court issued an Order Granting a Preliminary Injunction to plaintiff, Brianna Tahdoohanippah, who sued the Election Board for not being certified a candidate for the March 5, Primary Election. The Court's Order halted the scheduled elections on February 18, 2025, March 2, 2025, and March 5, 2025. The Court also joined the Ho-Chunk Nation Legislature to the case as an Interested Party along with denying the Department of Justice's motion for Summary Judgement and Dismissal.
     A preliminary Injunction is a court order stopping parties from doing certain things or enacting certain laws until the Court can decide the full case. They can only be granted in cases where the Plaintiff can make a special showing to the Court, which the Court found in this instance.

     The Court held a hearing on Monday, February 24, to determine if it should continue the injunction or not.  The Court heard arguments form counsel for Brianna Tahdoohanippah, the Election Board, and the Legislature.  The Court did not make a ruling from the bench, nor indicate the temporary injunction would be lifted at that time.  Absent the Court lifting the injunction, the Election Board is unable to move forward with the March 2, and March 5 elections.
